Security Deposit Not Returned?

Why I'm Mad as Hell at Thurcon and Demanding Justice

The day before my daughter moved into 33 Gold Street we dropped off her furniture an locked the door. The next day, all of the furniture and other valuables were stolen. Thurcon admitted it was their fault but would only give us one month's rent as restitution. She kept the apartment in perfect shape and moved out when the lease was over. Thurcon Properties Ltd made us wait for 8 weeks for our security deposit.

I was shocked when they only returned $505 of our $1,450 deposit. Here's how they explained it:


Thurcon is charging us $100 for "double cleaning of appliances (Stove & Refrigerator etc) due to the filthy state it was left in" and $441 for "Carpet damaged, cut out damaged areas. and patch carpet, Vacuum, clean and shampoo stained and soiled areas or and replaced carpet," and Countertop Replacement / damaged with knife ... $300" plus other claims that total $945.

But Howard ... we have photos and witnesses that prove that your claims are false. Now, we are gathering all of your disgruntled tenants and ex-tenants and together we will get justice.
I want my $1,450 deposit back ... plus interest.

Either send us back our money or we will bring you to court and get justice.



To be clear - we are NOT accusing Mr. Harold Thurman of any wrong doing. We ARE seeking evidence of shady business practices - but we are NOT accusing Harold Thurman, Thurcon Properties Ltd, Gold Street Properties, L.P. of any wrong doings.

There are some nasty reviews of Thurcon and 33 Gold on CitySearch that, if true, would indicate that Thurcon regularly defrauds tenants:

"They withheld money from my deposit for the carpet damage they caused and other "normal wear and tear" items, such as regrouting and painting (I didn't paint the apartment or damage any tiles). In order to get any of the money from my security deposit back, I had to waive all claims against them (they used a restrictive endorsement on the check)."

"When I was moving out, they failed to abide by the terms of the lease agreement and did not return the security deposit."

I have no idea if these statements are true - and that's why I want to organize a tenant group. Let's see how many tenants we can gather.

According to New York State Division on Corporations, Howard Thurman, is the owner of GOLD STREET PROPERTIES, L.P. and its management company THURCON PROPERTIES LTD, NYS license 109908667. One of his addresses is:

  1. I recently moved out of 33 Gold Street with the exact same complaints. Did you return to your daughters apartment after she moved out to see if they actually made those changes they charged you for? My roommate and I returned to ours and found that nothing they charged us for was replaced. The counter was exactly the same, the closet door (which was broken when we moved there and when we left- Santiago never answered any of my several requests) was still broken. They charged us to replace the smoke detector (which was there when we left), and oddly enough when we visited the new tenants there was NO smoke detector. They're complete crooks, I'm gathering all of this information and taking them to small claims court. I haven't been able to contact Harold Thurman but have been speaking with Amanda and Angela at the office. They're so delightful, it almost makes me want to move back...

    1. Did you end up taking them to Small Claims Court? If you won a judgement and it hasn't been paid, you are entitled to triple the amount of damages. Email suethurcon@gmail.com if so and with myself and one other person we have enough to sue for triple damages.

    2. This company is a joke and Amanda Ortiz and Donald De,simone are the nastiest people to ever deal with. They are very rude and disrespectful. They steal everyones security and make up reasons why they kept it. Santiago and Willie do whatever Donald the so called leasing manager tells them to do and say. Take pictures and take that slum loard to court.

      If you have any way of gathering evidence that the apartment was in good shape when you left, document it.
      Then, file a claim.
      This company does not care about doing the right thing. They only care about money.
      Take them to court - it is the only thing they respond to.
      Also ... if you have any friends in the building - please warn them to verify and document everything. Tell them to never move out without doing walk through inspection (and have Thurcon sign off before you move.)
      Let me know if you need anything else.

  4. How do we get involved with this class action lawsuit or complaint with the AG's office. I will walk around the building and gather signatures if need be.

    1. Have you successfully sued them in small claims court and won? If so, only one other person is needed to file a class action with all the other tenants who've been defrauded, which is probably hundreds if not thousands.

    3. Has anyone ever gone in person? I am getting the run around by email, fax, phone, and certified mail for over a year and a half. I have emailed suethurcon with my problem.

  5. The first thing we need to document these complaints. Have you sued them in small claims court? The more of us that do the easier it is for the AG to build a case.

    2. I sued them in small claims court and won a judgement in 2015 which has still not been paid. According to the judgement, if there are at least two other unpaid small claims judgements we can begin an action for triple the amount of unpaid claims, plus attorney's fees. We can also notify the housing board to revoke their license and notify the NY State Attorney General. Please respond below if you have an outstanding judgement and we can start a tenant group.

That Amanda and Donald are a joke.. they both are useless, but Mr. Thurman and his son think they have two good workers. Mean while they are nasty and rude. I heard Donald call one of the supers a little bitch. These people abuse there power and are very disrespectful. Put this company out of business

  6. I am having the same issue with highly exaggerated repair claims. I don't have any proof at the moment that the apt was not in these conditions (some of them were true...although for an exorbitant repair cost). What should I do?

    1. Take them to court and let the judge decide. Gather what evidence you can. For a few hundred dollars they may decide it is cheaper to pay you off than have to send a lawyer or employee.

  8. File suit in small claims court and document everything you have. It only takes a few weeks and if you and one other person win then there are enough claims to start a class action with all the tenants who've been defrauded.

I am organizing a tenant group to explore options for getting our money back, including triple damages in Small Claims Court and possibly a class action if enough people have been defrauded (at least 40, according to a lawyer I've spoken with).     1. My son judged moved out of 106 fulton. They kept $460 of his security deposit saying he didn’t paint the apartment. Everyone knows the landlord paints the apt unless it was a different color, then the tenants have to paint it back to the original color. I want to be part of this class action suit. Please advise. Marilyn

  10. I'm thinking about moving here (to the 7th floor duplex). I don't mind gathering meticulous documentation -- have won & enforced judgments in NY Superior Court before. As a former tenant, please tell me...am I crazy to even consider this building? Would rather not pony up $$$ for the schmancy cookie-cutter condos.

    1. Do not go anywhere near this place. On top of not returning your security deposit, they will refuse to repair your apartment, charge you bogus fees for late rent when they can't find the check (or don't want to find it) and the building is a disaster. I lived there for a year and a half and had to get out due to mice, cockroaches, water bugs, and the building being heated to almost 100 degrees in the winter.

  11. PPS I'm all about triggering treble damages, but if you want your money sooner, you can hire a state Marshal to enforce it. Not very expensive. You'll need to tell them the bank holding company where the corporation has assets, as well as the account number. In most cases this info has to be subpoena'd via the court system (slow, expensive), but in your case it's easy, assuming you paid rent by check: just have *your* bank look up where the money went.

      As far as the rental experience there ... I moved daughter's dresser and a few other pieces of furniture in a few days ahead of the lease start date. (How nice) ...
      Every item was missing when we came back. Gone! Stolen? Accidentally discarded? Management did nothing to help us find out. Very, very bad feeling about this place.

  12. Hi - I just moved my daughter into 211 Thompson on 4/15 which is another Thurcon. Donald DeSimon is the Property Manager and the experience is bad. No gas in the unit and no idea when it will be restored, couldn't move in for 5 days due to asbestos abatement. Super's phone number rings once and disconnects. Painted over wall faceplates and no idea if a Time Warner cable terminates at the unit. I can see where this is heading.

    2. Thanks - yes, this will be a 1 and done. Good experience for my daughter....I'm just the daddy guarantor and designated fixer! Plan is to not pay last month's rent and let him apply the deposit or come after me.

    4. Donald is not the Property Manager he is the rude so called Leasing Manager. It is illegal for your daughter not to have gas especially if they dont have an updated certificate of occupancy with the city.... You should look into seeing if they have an updated certificate of occupancy on file with the city if not you are entitled to all of your money back and your daughter can move. I know because I am a PM and one of my bldgs. I manage had a TCO and a tenant didnt have gas for months and we had to refund her full security and let her move out without a hassle. Trust me look it up. Thurcon is a complete joke and crooks

    I just moved in with my friends @33 Gold St. Unfortunately, only saw the ratings and reviews after signing the lease. Donald seemed like someone who doesn't really care after 2 email exchanges. My realtor said that they were trying to improve which I think is untrue after seeing recent reviews in here. I am here asking for tips and instructions to move out smoothly when my lease ends because I am definitely trying to get my security deposit back! Thank you guys so much and I am very glad I found this page!

  14. Take pictures of everything before and after you move. That way if they withhold security you have proof that any charges are unfounded.

  15. wow, this blog is really tough. glad i found it. i was considering renting here and moving cross country sight unseen. ive seen pics, and done 3 virtual tours and everything seemed spot on. can anyone confirm that all of this mess still exists? im not so worried about the security deposit, moreso the bedbugs, cockroaches, mice, drug deals, broken things....

  17. Hi. I wanted to let everyone know I moved out of there 106 fulton street building in May, we actually moved out way earlier and they were kept up to date on all of that. Never missed a rent payment and cleaned the apartment well when we left. For month’s, they avoided our emails, would not call back and kept saying they mixed up our addresses over and over and over again so as to never give us our deposit back. After contacting them so many times, with them saying they were “getting on it,” or “We already spoke to your other roomate so you can ask her about it.” Which they did not, we decided to send them a letter about how we were in fact ready to take them to court. It was only a short while after that where they emailed us to say they had just sent our deposit back. We moved out before May 1st... received our deposit in july... if you do not push back and demand to at least have written confirmation of why your deposit isnt being sent back, they will never send it to you.
